    A transitional adult home is an adult home with a certified capacity of 80 beds or more in which 25 percent or more of the resident population are persons with serious mental illness.

    Operator must submit a compliance plan to reduce the mental health census to under 25 percent.

    Annual physician's statement for employees with direct resident contact, confirming no health impairment posing risk to residents or interfering with duties, and including TB risk assessment/testing and other required tests.

    No individual suffering from mental illness, habituation, or addiction that causes danger to self or others, or interferes with duties, shall be employed.

    No individual with a communicable disease that might endanger residents shall be employed.

    Employees with direct resident contact must be emotionally, mentally, and physically able to provide services and supervision, maintain personal hygiene, and be able to speak, read, and write English, and speak the predominant language of residents.

    No person under 18 years of age shall be charged with direct responsibility for supervision and personal care of residents.
