    Must be licensed as a residential care facility if providing residential nursing care or administering medications

    Cannot provide comprehensive nursing care except as allowed by rule

    Applicant must submit a license application, appropriate license fee, detailed architectural and operational plans (for new construction or changes), notification of design release, written notification of substantial completion, corporate/partnership structure, list of previously/currently owned facilities, copies of agreements/contracts, registration if required by Secretary of State, staffing plan, disaster plan, documentation of compliance with article and statutes, report by state fire marshal for fire safety compliance, verification by building official for building rules compliance, and independent verification of assets and liabilities

    Resident must be discharged if a danger to self/others, requires 24-hour comprehensive nursing care/oversight, requires less than 24-hour comprehensive nursing care/oversight/rehabilitative therapies and has not contracted with a licensed provider, is not medically stable, or meets two of three criteria (total assistance with eating, toileting, transferring) unless medically stable and facility can meet needs
