    Acceptance and retention of residents based on facility's capabilities

    Residents must be housed within the facility

    Cannot accept or retain residents requiring care exceeding licensure

    Healthcare personnel cannot leave facility during duty to provide services to non-residents (except emergencies)

    Residents must be able to complete ADLs independently or with assistance, feed themselves with setup/supervision, manage medications (self-administer or administered by qualified personnel), remain free from restraints (except memory care), receive skilled services, and maintain stable/controlled conditions not requiring frequent nursing care
